Franchise Law has grown up in England and Wales very much as part of the common law of the country.  Very few cases deal with franchise as a distinct area of law.  Where questions of Franchise Law have arisen, courts have on occasion turned to the guidelines of the British Franchise Association ("BFA") as the nearest comparable framework to a set of laws in this area.  As a result of this relative lack of regulation the industry has had a lot of freedom to grow and prosper.  However, the BFA have been instrumental in providing the industry with a quasi regulatory rigour.  This has been done by stringent entry requirements which have provided members of the BFA with a form of reassurance to parties that their members have signed up to abide by the ethical guidelines and other standards required of them.
